Privacy Policy

This Privacy Policy applies to the activities and operations of Loyaltician CRM India Private Limited and its affiliates and group companies (collectively referred to as “LCRM” in this policy).

For the purpose of this policy document – ‘You’ or ‘Individual’ hereinafter denotes and defines the user, prospect, member or an individual with whom the company interacts with for sales, marketing, business engagement and business transactions. By visiting this web page or our mobile application you are agreeing to the terms stated hereunder relating to Privacy.

For the purpose of this policy document – ‘Client or Clients’ is hereinafter referred to as Hotels, Clubs, Retail Stores, Malls or any other businesses that have an express agreement with LCRM to conduct business / marketing operations for them for a specific tenure and objective. LCRM represents clients for marketing and sales activity under various service agreements.

This policy explains how LCRM handles personal information and complies with the requirements of the Privacy Act. Collecting information about you

In accordance with the applicable Acts governing Privacy, LCRM only collects personal information that is necessary for business purposes. We endeavour at all times to collect personal information in a fair and lawful manner, and to meet our members’ expectations that we will respect their right to control how their personal information is collected and used.

LCRM collects personal information to be used for the purpose of its business. These include:

Prior and Post purchase of LCRM promoted Memberships, Club Memberships, Hotel memberships, software, timeshare memberships or similar businesses.

LCRM collects information about members and prospects at the time when a person joins a calling list, a program, and while an individual decides to enroll as a member by accepting of terms or paying a membership fee. This data of individuals with whom the company will or can deal with could also include (but not limited to) data of individuals available in the public domain, directories, business lists, email campaigns, third party email campaigns, public data acquisition example at a retail outlet or a mall, social media campaigns, digital leads on websites, blogs, internet search, influencers, direct mailers, individuals dropping their details or business card or transacting at a Client location. Further, these could also include individuals who are referred to by existing prospects and members and individuals who decide to visit our website and group/affiliate websites and leave their details.

The information we collect

The main categories of information we collect relate to an individual’s general contact information, personal details including spouse/family members details such as name, age range, gender, demographic information like postcode, preferences, interest, professional details, address, contact information including e-mail address, use of the program, payment details, responses to surveys, Know Your Customer (KYC) documents as mandated by Government authorities and other details, which are usually collected directly from the member like a photograph.

Individual Agreement for Sales, Marketing, and management of LCRM promoted Client memberships

By providing us with the information, you are expressly agreeing to our terms and conditions. If you do not agree to the policy, your membership cannot be managed at all.

  1. The individuals (members) expressly confirm all terms including the privacy policy by accepting the terms prior to membership enrolment and do understand in advance that personal information is sought to serve their membership during their membership tenure. They are considered as Opted in.
  2. The individuals (prospects) expressly confirm all terms including the privacy policy and do understand in advance that personal information is sought to complete their membership enrolment and service their membership during their membership tenure.
  3. The individuals do confirm that Loyaltician can source their information for the sales and marketing of client memberships as mentioned in Point 1 above.
  4. Any individuals who sign up for a Do Not Call facility or unsubscribe on emails available on the program-related website are not reached out to promote offers. In case of escalations, the LCRM Grievance policy is activated for the benefit of the individuals as detailed in this document.
  5. Individuals can also reach out to LCRM on the escalation contact details given in this document.
  6. LCRM collects personal information related to membership management, booking rooms, booking tables, collections, and as necessary for other purposes related to the management of memberships of individuals who become members of LCRM client memberships. Further personal information may be collected in specific instances such as in the event of an incident occurring on site for legal and insurance reasons. 
  7. LCRM may collect information on individuals when they book their travel arrangements, in order to process the transaction and to fulfill booking requests with travel and tourism operators.
  8. LCRM also collects general business information relating to employees, contractors, shareholders, resort managers, and other individuals.

This policy explains the main features of LCRM’s use of members and prospects information and does not outline in detail the use of contractor and employee information.

Using and disclosing your personal information

Our purpose in collecting information about you is to provide you with personalized membership services, including servicing your membership tenure for the facilities at a Client location. LCRM uses personal information in several different ways in operating our membership programs and operating our business, improve our product and services, and most of these uses are clear from the circumstances. We also use your personal information for internal quality assurance purposes.

LCRM provides this personal information to clients and affiliates under strict control in order to facilitate a booking that you have requested or to service a request that may be delivered by our client. LCRM does not routinely disclose personal information, except where it is necessary to provide you with a service that you have requested. LCRM will not normally otherwise use or disclose any information about you without your consent, unless: required by law to protect the rights, property, or personal safety of another LCRM member, any member of the public, or when the assets and operations of the business are transferred to another party as a going concern.

When you provide your personal information to us, LCRM will give you the choice as to whether or not you wish to receive further information about special offers, promotions, and changes to our products and services. If you indicate that you do not wish to receive these, we will not contact you further for these purposes. Please allow 24 business days for your request to be processed.

Service providers

Like many businesses, LCRM uses a range of service providers to help us maximise the quality and efficiency of our services and our business operations. This means that individuals and organizations outside of LCRM, such as mail houses, will sometimes have access to personal information held by LCRM and may use it on behalf of LCRM. We manage our service providers to adhere to strict privacy guidelines and not to keep this information or use it for any unauthorised purposes.

LCRM and marketing activities

LCRM manages communications with members, prospective members (prospects), and customers according to its privacy policy. We respect individual’s choices about being contacted for marketing purposes. We may occasionally contact you by SMS, Email, Letters, and voice call that you provide to us in order to:

Remind you of your membership renewal or warn you of the upcoming expiry of membership benefits.

Provide you with updated information about our services or special promotions.

Provide you with other information about other products and services which you may have an interest in.

Some of this information is necessary as part of our communication about the LCRM program and is sent to all members. However, if you are receiving promotional information from LCRM  and do not wish to receive this information any longer, you may remove your name from our list by contacting us on our Help Desk and asking to be removed from our mailing list. Please allow 24 business days for this request to be processed. Business timings: Monday through Friday 11 AM to 6  PM. Closed on National Holidays.

LCRM is committed to high standards of data security with respect to information collected on our site and group sites including managed client sites. We offer SSL encryption, the industry standard security measures for transactions made over the Internet.

New technologies are emerging on the Internet that help us deliver customized visitor experiences. At LCRM, we primarily use “cookies” to help us determine which service and support information is appropriate to your computer and to facilitate your use of our instant transactions area. Our use of this technology does not mean that we automatically collect additional information about you. We might be able to ascertain what type of computer you are using, but beyond that, our use of cookies is designed only to provide you with a better experience when using our websites.

A cookie is a piece of data stored on the user’s computer tied to information about the user. We may use both session ID cookies and persistent cookies. For session ID cookies, once you close your browser or log out, the cookie terminates and is erased. A persistent cookie is a small text file stored on your computer’s hard drive for an extended period of time. Session ID cookies may be used by PRP to track user preferences while the user is visiting the website. They also help to minimize load times and save on server processing. Persistent cookies may be used by PRP to store whether, for example, you want your password remembered or not, and other information. Cookies used on the PRP website do not contain personally identifiable information.

For our Mobile App users:
When you download or use apps created by LCRM or our subsidiaries, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with location-based services, such as advertising, search results, and other personalized content. Most mobile devices allow you to turn off location services. We may collect information about you as stated herein above for the purpose of downloading our mobile application in your mobile phones. The information that we gather is only for the purpose of providing, improving the product and services provided to you.

When you use our applications, we also process technical data such as your IP-address, Device ID, Device Contacts, and information about the manufacturer, model, and operating system of your mobile device. We use this data to enable us to deliver the functionalities of the services provided by LCRM, resolve technical difficulties, and provide you with the correct (prevent the transmission of spam, viruses and/or unlawful, defamatory, obscene or otherwise undesirable material or content) and most up to date version of our APP.

You can access the information we keep about you

If at any time you want to know exactly what personal information we hold about you, you are welcome to access your record by reaching out to us on our Help Desk. Our file of your information will usually be made available to you within 14 days. For security purposes confirmation of your identity will be required prior to supplying of this information.

Changing and deleting the information we have about you

If at any time you wish to change personal information that is inaccurate or out of date, please contact us on our Members Help Desk and we will amend this record. If you wish to have your personal information deleted, please let us know in the same manner as referred to above point No.6 and we will take all reasonable steps to delete it unless we need to keep it for statutory or regulatory requirement.

Storage and security of your personal information

LCRM endeavors to take all reasonable steps to keep secure any information that we hold about you, and to keep this information accurate and up to date. LCRM uses a sophisticated computer data network, and all access to the computers and system devices is password controlled. Employees can only gain access to data if they are authorized, and we maintain an audit log that records each time a file is accessed. We also require our employees and data processors to respect the confidentiality of any personal information held by MHRIL. Data is secured in a secure data centre environment, with daily backups of all data taken and a copy of all data kept offsite. Our data network is totally private and not accessible over the Internet. We use sophisticated detection and intrusion technologies to ensure that there are no network security breaches.

Under no circumstances, including but not limited to negligence, LCRM or its officers or employees shall not have any liability of any nature whatsoever, in respect of personal information provided by you.

Transfer of personal information overseas

Please note also that as a business, LCRM may use overseas facilities to process or back up the information that it holds on servers like Amazon Web Services. As a result, we may transfer your personal information to our overseas facilities for storage. However, we will only transfer information overseas as authorized by the applicable Privacy laws and in keeping with our other commitments to safeguard your privacy.

Grievance and Escalations

LCRM is committed to be a fair and responsible organisation. We take any escalations or issues seriously and work to address these concerns in a just manner. We are available from Monday to Friday from 11 AM to 6 PM except on National Holidays on our Help Desk to resolve any issues and escalations.
